Is cold email allowed for financial advisors?

Yes. Cold email is allowed for financial advisors, as long as it follows the rules that govern commercial email and advisor communications. There is no rule that bans advisors from sending cold email. What the rules govern is how you do it: honest identification, a working opt-out, accurate claims, supervision, and retained records.

The rules that apply

CAN-SPAM. Every commercial email must identify itself honestly, include a valid physical mailing address, and give the recipient a clear way to opt out that you honor promptly (generally within 10 business days). This applies to all commercial email, advisors included.

FINRA Rule 2210 (for FINRA-registered representatives). This rule sorts communications into categories with different review requirements. Email to 25 or fewer retail investors in a 30 calendar-day period is generally “correspondence” with lighter supervision; more than 25 retail investors in that window is generally “retail communication,” which usually needs principal approval before it goes out.

SEC marketing rule (206(4)-1) (for RIAs). Outreach that promotes the firm must be fair and accurate, with no untrue or misleading statements and no unsubstantiated claims.

Recordkeeping (SEC Rule 204-2 / FINRA). Business-related emails must be retained, generally for five years for RIAs.

What compliant cold email looks like in practice

  • Accurate “from” and subject lines, no misleading routing.
  • A real physical address in the footer.
  • A working unsubscribe link, honored promptly.
  • Claims you can back up. No performance promises or guarantees.
  • A review step before sending at volume, and a record of what was sent.
